Welcome to Dr. Jim Harris Ministries! These Terms of Service (“Terms”) govern your use of our website https://tki.global, and the email sending services, software, and tools offered by Dr. Jim Harris Ministries (collectively, the “Service”).

By creating an account or using our Service, you agree to be bound by these Terms and our Privacy Policy.

1. Description of Service
Dr. Jim Harris Ministries provides a platform for users to create, send, and manage email communications to their contacts (“Subscribers”). This includes, but is not limited to, marketing newsletters, transactional emails, and system alerts.

2. Account Registration and Security
You must be at least 18 years old to use the Service. You are responsible for maintaining the security of your account, password, and any data you store within the Service. You agree to notify us immediately of any unauthorized use of your account.

3. User Responsibilities and Acceptable Use Policy
You are solely responsible for the content of your emails and the management of your Subscriber lists. By using our Service, you agree to the following mandatory conditions:

3.1. Permission-Based Sending (Consent is Mandatory)

• You must have explicit, verifiable permission (i.e., opt-in consent) for every Subscriber you send emails to through our Service.
• You are strictly prohibited from using purchased, rented, scraped, or third-party lists of email addresses.
• Proof of consent must be retained by you and provided to Dr. Jim Harris Ministries upon request.

3.2. Content Requirements

• Identification: Every email you send must clearly and accurately identify you or your organization as the sender. A valid, physical postal address must be included in every email.
• Subject Lines: Subject lines must not be false, deceptive, or misleading. They must accurately reflect the content of the email.
• Prohibited Content: You may not use the Service to send emails that are illegal, pornographic, hateful, threatening, or that promote violence, discrimination, or illegal activities. This includes, but is not limited to, spam, phishing schemes, and malware distribution.

3.3. Unsubscribe Mechanism

• Every email must contain a conspicuous, single-click, and fully functional “Unsubscribe” link that is easy for the Subscriber to see, read, and understand.
• You must honor all unsubscribe requests promptly, and in no case later than 10 business days after receipt. You may not charge a fee, require the recipient to log in, or take any step other than sending a reply email or visiting a single page to unsubscribe.

3.4. List Management and Hygiene

• You are responsible for regularly cleaning and maintaining your Subscriber lists to remove invalid, hard-bounced, and unsubscribed addresses.
• Accounts with excessively high bounce rates, spam complaint rates, or unsubscribe rates may be subject to review, suspension, or termination.

4. Our Right to Monitor and Terminate
We reserve the right, but do not assume the obligation, to monitor the content and performance of emails sent through our Service. We may, at our sole discretion, suspend or terminate your access to the Service without notice for any violation of this Acceptable Use Policy. This includes sending unsolicited emails (spam), high complaint rates, or using the service in a way that could harm our reputation or email deliverability infrastructure.

5. Limitation of Liability
To the maximum extent permitted by law, Dr. Jim Harris Ministries shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; or (c) unauthorized access, use, or alteration of your transmissions or content.

6. Governing Law
These Terms shall be governed by the laws of Pensacola, Florida, United States, without regard to its conflict of law provisions.

7. Changes to Terms
We may modify these Terms at any time. We will notify you of any changes by posting the new Terms on this site and updating the “Last Updated” date. Your continued use of the Service after any such change constitutes your acceptance of the new Terms.
